How much time could my husband be facing for 2 counts of identity theft ORS 165.055?

He was arrested in my driveway on February 13th 2011. He was told he had a warrant in another city and was taken to the county jail here for 2 days then transported to Grants Pass. He went through pretrial and they are keeping him in custody until March 9th where he will enter his plead of guilty. Will he be let out on good behavior? He hasnt been in any trouble since 2007. Now these charges that werent taken care of in 2007 have came back for him and he is being charged with 2 felonies. His attorney told me he wont do more than 10-20 days in jail but I am really scared he might go upstate and do time in prision. The worst part is I am having his first baby boy on Wednesday. Please help
